As of right now as long as you don't have a card and are signed by a MLB team you can be drafted as a prospect, even if you have had experience in the MLB, ie Yonder Alonso.
As RANT mentions above if you have been carded in the past, it would make sense however that you would not be a prospect. IE a guy who has played in the MLB but missed a season due to injury. ie Adam Wainright (if he was available)

Unless someone is going way off the map, I don't see this being an issue atleast for hte 1st round. As Jorge Soler has not signed at this point he will be removed as an available prospect for this draft.
