I would think the first option is fairer as the people who chose a franchise first got a team full of players and the FA draft is but one player at a time. Also in the second option the last person to pick a franchise would get first choice of one player and then the last FA selection which hardly makes up for getting the last pick of franchises. Just my 2¢.
While this is certainly true in a no cap league, and I've been in some that were non serpentine for the free agent portion, I would argue that the 75mil cap makes the usual advantage of picking first non existent. My 25 protected players add up to about 71.7 I'm pretty sure everyone will easily be able to field a team around that number. In fact I was hoping to get 12th pick for that reason just to get first crack at the free agents. Maybe my thinking is wrong here but I would trade 12th pick for 1st in the free agent draft even if it's 12-1, 1-12
